SMS messaging program terms
Program name: 5EM Solutions Booking Confirmations.
Program description: 5EM Solutions answers inbound phone calls on behalf of contracted golf courses and other small businesses. When you call one of these businesses and request a tee time or ask a question, we send a transactional text confirming that request or providing the information you asked for. We also send operational alerts to employees of the client business who are named in that business's service agreement.
How to opt in: Consent is collected verbally during a call that you place to the business. Before the call ends you are asked whether we may text a confirmation to the number you are calling from, and told that you may reply STOP at any time and that message and data rates may apply. A message is sent only if you agree. We never use text messages to solicit permission to text you, and we never message a number that has not contacted the business.
Message frequency: One message per call you place. This is not a recurring or subscription program. There is no message series and no ongoing schedule.
Cost: There is no charge from 5EM Solutions for these messages. Message and data rates may apply depending on your mobile plan.
How to opt out: Reply STOP to any message from us. You will be removed immediately and permanently, and you will receive one final message confirming that removal. To rejoin, call the business again and give consent on that call.
How to get help: Reply HELP to any message, email paul@5emsolutions.com, or call the business directly.
Carriers: Mobile carriers are not liable for delayed or undelivered messages.
Privacy: No mobile information, phone number, or SMS opt-in consent is ever sold, rented, or shared with third parties for marketing purposes. See our Privacy Policy.
Supported carriers: Messages are supported on major U.S. carriers. Carrier support may change without notice.
Use of our services
Services are provided to businesses under a written service agreement, and to their callers as described above. You agree not to use our services unlawfully, to interfere with their operation, or to attempt unauthorized access to our systems.
Accuracy of confirmations
A booking is confirmed only when the message you receive says it is confirmed. A message stating that a request was received is not a guarantee of a reservation. If a message appears wrong, call the business directly — the business's own records govern.
Architectural visualization work
Rendering work is quoted per project. A free draft carries no obligation on either side. Final images are delivered on payment, and the client receives full usage rights to the delivered images for marketing and sales. Source scene files remain the property of 5EM Solutions unless otherwise agreed in writing.
Disclaimer and limitation of liability
Services are provided "as is," without warranties of any kind. To the maximum extent permitted by law, 5EM Solutions is not liable for indirect, incidental, or consequential damages, and total liability for any claim is limited to the amount paid for the service giving rise to it.
Changes
These terms may be updated. Material changes will be reflected in the date above.
Governing law
These terms are governed by the laws of the State of North Carolina.
